And what degree of AI used causes it to be a problem.

For example if an auto tune device used AI to do the autotune, would that earn the track an AI flag?

It's a fucking minefield.

What is the criteria for "fraudulent"?

In the article, uploading tracks intended to be streamed by your bot farm rather than real people to get artificially inflated royalty payouts. I'd add using track or band names from popular artists to that as it intentionally misleads listeners into streaming something they didn't intend to.
