NDAs: a legal weapon used to silence and intimidate

Companies, and individuals, have a range of ways to make sure stories about misconduct do not spread. Most financial settlement agreements between accused and accuser include non-disclosure provisions that bar the person receiving the financial settlement from talking about their allegations or even revealing the amount of the settlement, according to lawyers who have represented women in sexual harassment cases. Non-disparagement provisions, which prevent an alleged victim from speaking ill of the person or company they have accused, are also common. The penalties for breaking this silence can be steep. “A lot of defendants and the companies they work for are powerful. They can put in draconian liquidated damages provisions in the event there is disclosure,” says one lawyer who has worked on such cases. For example, an alleged victim might be forced to pay back not just the full amount of the settlement but also an additional financial penalty and the other party’s legal fees. “There is a lot of fear hanging over your head,” the lawyer says. Many of the women who received settlements after accusing Roger Ailes, the former Fox News chief executive and Bill O’Reilly, one of its key presenters, of sexual harassment do not feel free to speak publicly about their experiences because of NDAs. That includes Gretchen Carlson, who received a $20m settlement in a lawsuit she filed against Ailes in 2016 that set off a cascade of allegations about the cable news network’s most powerful figures. Ms Carlson has become an advocate for prohibiting forced arbitration clauses and their accompanying NDAs. “We have chosen as a culture to silence the victims either with settlements where you are gagged from ever saying what happened to you or enforced arbitration, which is a part of employment contracts now, and here’s the key — it’s secret,” she told CBS News last week. However, NDAs cannot lawfully prevent people from reporting claims to law enforcement and government agencies, such as the Equal Employment Opportunity Commission in the US, or responding to a subpoena. Allegations of sexual harassment or misconduct can also be kept quiet by limiting what employees can say about their workplaces. Employment contracts often include NDAs. Many also require that any complaints, including sexual harassment, be resolved in private arbitration rather than a courtroom. Those arbitration-only clauses — which are being challenged in a Supreme Court case — typically limit what a worker can say about the complaint and the ensuing arbitration. “All of these operate to silence survivors of sex harassment and sex assault from coming forward and reporting, and they also help shield serial harassers from accountability,” says Maya Raghu, director of workplace equality at the US National Women’s Law Center. “As we’ve seen in the last few weeks, many survivors feel like ‘I’m the only one who this has happened to’ — so they stay silent.”

Paddington 2: Producer hopes to sever connection with The Weinstein Company
David Heyman told Deadline that The Weinstein Company had distribution rights but had nothing to do with the financing or making of the film.
Heyman said his hopes are that, ultimately, "The Weinstein Company name is nowhere near Paddington 2".
Heyman, who is also behind the Harry Potter movies, spoke about his unease at being involved with The Weinstein Company.

"It's very sad and deeply frustrating that Paddington, who's been around for more than 50 years, and is always looking for the good in people...could have any association" with the ongoing scandal, he said.

I'm not sure, but moving forward I think actors and actresses are going to be more careful with who they associate.
That or money will corrupt them and take over real human values that are much more important and precious in life.

Sex exploitation, human abuse, prostitution, child pornography, abuse of power on all levels and segments of our society is becoming more and more a public rejection. The awareness, the dénonciation, the breaking of silence, the what is happening right now from all the women speaking up, is good, very good. It is the best that could happen. Everyone is involved; the entire Hollywood film industry, the filmmakers, actors, producers, executives, movie studios owners, actresses, lawyers, judges, forces of order, police, detectives, ...everyone more or less directly related.

After all, it is their children who they are raising with those values; all their children from the judges, the lawyers, the film producers, the everyone who participate by their silence and barriers and obstructions of the truth to surface. It is all their children that they are raising in that environment.

If money corruption, abuse of power, women sex exploitation are to be tolerated by hiding it with silence, with laws that protect these criminals, with lawyers who think they are doing their jobs by the book of laws, without merits, without true values, with protecting the criminals, and dishonoring the victims, ...then they got it all wrong from a totally failed system that they are slaved of, that they themselves are guilty in adopting.
Their children have nothing good to learn from them, to the contrary, they are impregnating, brain washing them with the wrong life values.

Time to wake up, and do what's right, and not what a failed system we have become addicted to and corrupted by. Cut the head of that snake, stop the money trail, stop protecting the rich scumbags abusing their power over others, stop protecting the sex perverts, stop protecting the people who spoil the children's future, stop being silent because by your silence you are no better than people like Harvey Weinstein, you are @ the same level as him, you have power too and you are using your power by being silent and encouraging that despicable disease rampant in Hollywood, in the film industry, and all over in all other lines of work where young women and children are abused and taking advantage of, mistreated, physically and mentally destroyed, and it is a responsibility that we all have, period. Forget the book, forget the I'm just doing my job, grow up and do what's right. That's the only way, the only valid way to win an Oscar. Your talent is only good as who you truly are, on stage as in real life.

Showing your age, possibly. The modern, progressive way to refer to actresses is "actors". However, it has been noted that in the case of the Weinstein scandal, those progressive media outlets who previously were careful to use "actor" have suddenly started using "actress" again!

You are right; actors imply both male and female people.
From now on I'm going to work on this by remembering and adopting. Thank you.

And with Weinstein it's the female actors who are abused, the young actresses.

But men are also abused, the actors who are afraid of speaking out.
They create their own abuse by being silent, like a spreading disease they encourage themselves and give to their children. It's their fault what they aren't doing, it's them who are guilty as much as the perpetrators, the raptors, the decimators.

And one thing that they should talk about to is, young men actors who get abused too, by pedophiles, by older film producers who love little boys and use them as sex objects and to satisfy their sexual desires. These young men actors are marked for life; they don't know anymore what love is, who to trust, they too live in fear, hiding for the rest of their life...some.
That too has to stop, by being exposed fully and talked about strongly, and by denouncing them all the Hollywood zoo perverts.
If we don't we keep raising our children in that sick Hollywood film atmosphere.

Is this what we want, ...I didn't think so.

It's like taboo, nobody wants to admit and talk. It's a sickness derived from the pure evil of fear. Stop this sh*t right now and get rid of all the sex perverts, addicts, abusers in Hollywood and everywhere. It makes the world sick in their stomach big time. Enough, right now, not tomorrow or the day after, but right the fuc*in now.

These stars they have a huge adventage; they are well known, they are famous, they have tuxedos, shining black shoes, some even have golden globe trophies, Oscars, congratulated by their peers and partners, stars engraved on the sidewalk of Hollywood boulevard, they have a huge audience, they have tremendous power to show, to lead from their example. They are the ones who can make a real difference, influence the lawmakers and our leaders.
We don't need the Weinstein, the Cosby, the Allen, the Polanski, ...we don't need no more of all the people like them. In Hollywood, in the entertainment business, in the news anchors, in the media industry, in the schools, the football teams, the universities, the financial institutions, on all levels of our democracy and moral values, our fundamental reasons of living and leaving people alone and free of persecution, living their lives with respect. No more abuse, no more indignation, no more stalking, it's time to change the winds in the correct direction, time to shift gear, time to admit, to condemn, to rectify, and to get on the right track.

What is a star? It is a light, a shinning light in the sky showing us the direction when we get lost @ night, in the dark, in the blackness of emptiness.

Indeed the dirtiness is what attracts many to want to get involved with "hollywood." Can't believe all the actors and actresses coming out saying, "oh I did not know." Might as well say earth is flat. Sexual advances and such is the norm, not the exception.

MPR will end its business relationships with Mr. Keillor’s media companies effective immediately. By terminating the contracts, MPR and American Public Media (APM) will:


* end distribution and broadcast of The Writer’s Almanac and rebroadcasts of The Best of A Prairie Home Companion hosted by Garrison Keillor;

* change the name of APM’s weekly music and variety program hosted by Chris Thile; and,

* separate from the Pretty Good Goods online catalog and the PrairieHome.org website.


MPR also explained its legal process leading up to the decision to walk away from Keillor. After the board’s chair was informed, an oversight committee was formed and the company brought in an outside law firm to independently investigate the allegations. That investigation is still on-going, and MPR says it has not uncovered any similar allegations against Keillor by other staffers. “Over the last several weeks, the special Board Committee has worked closely with MPR President Jon McTaggart and legal counsel to review the facts as we know them and carefully consider the implications of the various options,” said David Murphy, Chair of the MPR Board of Trustees, in MPR’s statement. “The Board Committee concluded that terminating the Keillor relationships was the appropriate decision and the Board and Jon are aligned in this action.”

Everybody is getting fired nowadays, it's like that show...The Apprentice on TV; Hollywood people, TV people, politic people, bank people, ...they all are behaving like childs towards women...running naked and saying nasty things.
Everyone is on fire, even that ballistic guy from overseas.

Me I think that climate change mixed with Twitter and bitcoin and men bad attitude from their ego, power, money ...has a lot to do with it, in particular the later.
The more people want to be rich and famous with power the more sick they risk to become and make mistakes and abuse other people. ...A bad bunch of them. And it's not only women in Hollywood who are abused, but women and children and men everywhere on the planet.

Time to readjust the balance.

You gotta be careful with what you say nowadays. Everyone is listening and filming...cell camera phones. Records from years ago are revealed, digging the past is now a new pastime. I think it's very good for the future. It's about time that people speak up and that we are listening with our brain and heart instead of fear of losing our jobs. We have our values so wrong, we lost our dignity along the way, we let others control our lives. That makes zero sense.

The 'casting-couch' has been around since theatre began. It was not even a secret and was mentioned in many pre-WW2 movies and comedy acts. The major studios had fixers who were brought in to make sure any scandals were kept under wraps. Imagine the accumulated 'dirt-files' that could be used by the studios to control their players.

After this recent disclosure episode passes, most of the accused will be 're-imaged' and continue on in well paying roles. The accusers will no-doubt go down the whistle-blower road to oblivion.

This is not new news though Bob. I went through extensive sextual harrasment training and company suffered from tons of lawsuits when I worked for Sony back in early 1990s. All of the liability and admonishment was there in corporate world. So people should have known better, especially the HR departments. They needed to get busted for being 20 years behind times and busted they are. I think there will be tons more firings still to come.

I know that sexual harrassement started with Adam tempting Eve with an apple. ...The first man and woman on Earth, and the first snake ever filmed.

I am not five years old. What I'm saying is that we are seeing now a major change; the one of getting rid of our fear and do the right thing by condemning the wrong thing that has been going on since the creation of Adam and Eve, 200,000 to 400,000 years ago. It's very tough to know with accuracy.
Anyway, it's been going on for a very long time...human exploitation, slavery, abuse of power, sexual relations of all kinds, here very sick ones, like Weinstein was doing, and many many many others like him, before him and most likely after him, and also worst than him.
But we have the will to change that. That's my opinion and I congratulate the people who do take that human will for the rights of the human race...all women, children and men, and for the balance of wildlife, and for the harmony of our environment on a healthy and beautiful blue planet.

Live all what you got with all your love.
